K95 Name Game
Spring 2012
OFFICIAL RULES
1.NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2.Eligibility. Subject to the additional restrictions below, K95 Name Game (the “Sweepstakes”) is open to residents of the state of Virginia 18 years or older at the time of entry with valid Virginia driver’s license or ID. Employees of Cox Radio, Inc. d/b/a WKHK-FM and each of its respective affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win. The term “immediate family members” includes spouses, parents, grandparents, siblings, children, and grandchildren. The use of automatic telephone dialing equipment or other software or computer assisted dialing equipment is prohibited and will result in disqualification.
Contest winners are limited to one winner per household every 30 days for this Sweepstakes “K95 Name Game” and any other WKHK contest.
3.How To Enter. The Sweepstakes will begin at 12 AM (E.D.T.) on March 26, 2012 and will end at 7:00 PM (E.D.T) on June 22, 2012 or when the allotted contesting fund of $21,000 is distributed to winners, whichever comes first (the “Sweepstakes Period”). WKHK will begin collecting “Names” on or around March 22, 2012.
Enter by listening to WKHK Monday through Friday between the hours of 7:00 AM (E.D.T.) and 6 PM (E.D.T.) during the Sweepstakes Period. Listeners will be asked to listen for their first name, last name, and county/city they indicated when they signed up to the “Name Game” contest or indicated to the telemarketing company Americalist or indicated on any other entry method (their “Name”). When the announced listener hears their “Name” called, the listener must dial 804-345-9595 in 9 minutes and 53 seconds to collect the prize. Subject to compliance with the eligibility and other requirements of these Official Rules, the announced listener, after calling back in 9 minutes and 53 seconds will be declared a winner.
“Names” will be selected and announced from these methods: Contest Entry with Link only found through Facebook.com/K95Richmond, write-in entry and Americalist’s collected database of entries.
“Names” will be selected and announced from the list of people who enter the “Name Game” contest, which the link can only be found by visiting and friending facebook.com/K95Richmond. During the “Sweepstakes Period” listeners are encouraged to sign up to become an K95 Facebook friend if they are not already a member.
“Names” will also be selected and announced from Americalist, the telemarketing company contracted to advertise the “Name Game.” During the “Sweepstakes Period” they will be calling residences and businesses to collect names of people interested in providing their first name, last name and location, along with other general information. The listeners called will agree to participate in the contest by listening to K95 in order to hear their “Name” called for the chance to win.
WKHK will also accept “Names” via write-in letters addressed to WKHK Name Game or K95 Name Game, 812 Moorefield Park Drive, Suite 300, Richmond, VA 23236.
Enter as often as you like provided that multiple entries by means of software generated or other automated processes will be disregarded.
Sponsor will not be responsible for loss of service to the call-in line or for a contestant’s failure to reach the call-in line due to malfunction of any network or system, congestion, overload, busy signals, or any other factor that may prevent an individual from completing his/her phone call. In the event of interruption of power or telephone service to WKHK during a call-in period of the Sweepstakes and prior to accepting the call from the announced listener, the call-in period affected by the interruption may or may not be replayed at the resumption of service, at Sponsor’s sole discretion.
4.Winner Selection. Subject to verification of eligibility and compliance with these Official Rules, the announced listener, after calling back in 9 minutes and 53 seconds will be declared a winner.
5.Contest Rules. WKHK reserves the rights to adjust the contest rules any time during the “Contest Period.” In order to do so, WKHK must post the amended “Official Rules” online at k95country.com.
6. Prizes and Odds. Each prize winner within the contest period of Mondays, Tuesdays, Wednesdays and Fridays will receive $100. One winner each Monday, Tuesday, Wednesday and Friday during the contesting period will receive $1,000 instead of $100. Each prize winner within the contest period on Thursdays will receive $1000.
Odds of winning depend on the number of eligible entries received.
7.Winner Notification and Acceptance. Sponsor will notify winners during their initial telephone call to WKHK upon verification of their eligibility and compliance with these Official Rules.
Winners may waive their right to receive prizes. Prizes are non-assignable and non-transferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of sender’s postmark. Winners will be required to appear in person at 812 Moorefield Park Drive, Suite 300 Richmond VA 23236 and sign a W-9 and present a photo ID to a representative of the station. A copy of the ID will be made and sent to the Cox Media Group corporate headquarters, where the winner’s check will be processed. A check will be sent to the winner from Cox Media Group’s bank. Failure to timely sign and return the affidavit or release, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Any telephone calls placed to the WKHK call-in line may be recorded for use on air any time. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor. For prize winners list (available after June 30, 2012) or a copy of these Official Rules, send a self-addressed, stamped envelope to: K95 Name Game, “Winners List Request” or “Official Rules Request” (as applicable), WKHK, 812 Moorefield Park Dr. Suite 300, Richmond, VA 23236.
8.Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor which shall be final in all respects. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor. In the event the Sweepstakes is compromised by tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.
9.Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
10. Sponsor. K95 Name Game is sponsored by WKHK and Cox Media Group, Richmond. The decisions of Sponsor and Sweepstakes judges regarding the selection of winners, the interpretation of these Official Rules and all other aspects of the Sweepstakes shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Sweepstakes. Sponsor reserved the right to adjust the contest rules proving the adjusted rules be posted at k95country.com.
